Welcome to DZ Junk Hawlers LLC! These Terms and Conditions ("T&C") outline the rules and guidelines for using our services. By hiring us, you ("Client") agree to these terms. Please read them carefully.

1. Non-Discrimination Policy

DZ Junk Hawlers LLC operates in compliance with all applicable non-discrimination laws. We are committed to ensuring equal treatment for all clients, employees, and subcontractors, regardless of race, color, religion, gender, sexual orientation, national origin, disability, age, or familial status.

This policy applies to all aspects of our business, including hiring practices, subcontractor selection, service delivery, and customer interactions.

2. Scope of Services

We provide:

  • Junk Removal & Property Cleanouts

  • Yard Maintenance & Debris Removal

  • Exterior Cleaning & Soft Washing

  • Minor Handyman Services (non-licensed)

  • Equipment Rental Coordination

Exclusions: Hazardous materials handling, major repairs, licensed trades, or any services not listed here unless explicitly agreed upon in writing

3. Scheduling & Quote Response Time

  • While we aim to respond within 24–48 hours, please note that our service windows are optimized for after-hours and weekend projects.

  • If called directly, same-day or next-day quotes/services might be possible.

  • An $85 applies after quote approval, which will act as a deposit for scheduling.

4. Trip Fee & Cancellations

  • $85 Trip Fee: Non-refundable, applies after quote approval, which will act as a deposit for scheduling.

  • 24-Hour Notice: Required to avoid a $100 cancellation fee.

  • No-Shows/Last-Minute Cancellations: The trip fee is forfeited and additional costs may apply if materials or rentals have been secured.

5. Hazardous Materials

  • We do not handle asbestos, lead-based paints, oils, medical waste, or similar hazards.

  • We may organize them for a third party or decline to move them if deemed unsafe. We are not responsible for removal once organized.

DZ Junk Hawlers LLC strictly prohibits the handling of hazardous materials, including asbestos, lead-based paints, oils, medical waste, and other substances as defined under Florida law. Should our team identify any hazardous materials during service, we will immediately document the findings and advise the client to contact a certified hazardous waste handler. Clients are required to disclose any known hazardous materials prior to scheduling. In cases of accidental discovery, emergency protocols will be followed as detailed in our internal procedures

6. Dense Materials and Load Limits

  • For dense materials (e.g., concrete, dirt, tile): Full loads are capped at approximately 1 foot of depth in the trailer to meet weight safety requirements. Loads exceeding this limit may require a dumpster, which we can coordinate upon request.

7. Ownership of Removed Items

  • All removed items become the property of DZ Junk Hawlers LLC unless otherwise agreed in writing.

  • Any documents found during cleanouts will be returned to the client or designated recipient. We do not store or destroy documents after return.

8. Equipment Rental Coordination

  • Coordination Services: DZ Junk Hawlers LLC will arrange equipment rentals (e.g., stump grinders, chainsaws) necessary for service completion.

  • Client Responsibility: Clients are responsible for paying the rental cost directly to the equipment provider.

  • Coordination Fee: A $100 coordination fee applies for rental arrangement, pickup, delivery, and operation.

  • Vendor Delays: We are not liable for delays caused by the rental vendor’s availability or stock issues.

9. Client Responsibilities

  • Accurate Information: Provide complete details about the job, property conditions, and any required approvals.

  • Access & Safety: Ensure the site is safe, accessible, and free from obstructions or hazards. Unsafe conditions may result in delays, cancellations, or extra charges.

  • Permits & Approvals: Obtain any necessary permits, HOA approvals, and utility markings before service.

  • Utility Markings: Clearly mark underground utilities. DZ Junk Hawlers LLC is not responsible for damage to unmarked utilities.

Prior to beginning any service, our team will document the existing conditions of your property. DZ Junk Hawlers LLC is not liable for damage resulting from pre-existing conditions and unsafe site conditions (which includes but not limited to; structural damage, landscape issues, hazardous materials, water damage, mold/mildew growth, damaged roofing/gutters, unstable stairs/pathways, electrical hazards, wet surfaces, damaged materials provided by clients, etc.), or materials provided by the client.

10. Payment Terms

  • Homeowners: Payment due upon completion unless stated otherwise in writing.

  • Realtors & Property Managers: Net 30 from invoice date. A 2% monthly late fee applies after 30 days, up to 90 days.

  • Collection Process: Accounts unpaid beyond 90 days may incur legal/collection fees, which the Client is responsible for.

  • Late Fees: A 2% monthly late fee applies to unpaid balances after 30 days, up to 90 days. Additional collection costs may apply after that.

  • Quote to Invoice pricing: The quoted price is an estimate and is subject to change based on the actual scope of work, materials, and services required. In the event of any adjustments to the price, the client will be notified before the final invoice is issued.

11. Cancellation Policy

  • Small Jobs: Canceling less than 24 hours forfeits the $85 trip fee.

  • Larger Jobs: Canceling within 24 hours or less may result in charges for materials, coordination fees, or other costs.

  • Service Provider Cancellations: If we cancel a job, we will offer to reschedule or refund the trip fee.

  • Three-Day Right to Cancel: Florida law allows you to cancel within three business days without penalty if the agreement is signed at your residence.

Cancellations must be submitted at least 24 hours before the scheduled service to avoid penalties. Cancellations received less than 24 hours prior will result in the forfeiture of the non‑refundable $85 trip fee and may incur an additional $100 cancellation fee if costs have already been incurred. Additionally, if the agreement is signed at your residence, Florida law provides a Three‑Day Right to Cancel. All cancellation requests must be sent via email at DZJunkHawlersLLC@outlook.com and will be acknowledged within 24 hours.

12. Work Completion & Final Payment

  • A job is deemed complete once all agreed-upon services are finished, invoiced, and confirmed by the Client.

  • Full payment is expected at that time or per any agreed-upon Net 30 terms.

13. Satisfaction Guarantee

  • Five-Day Guarantee: Client must report any concerns within five (5) business days after completion.

  • Resolution: We will make reasonable efforts to address concerns if it’s within our control and scope.

14. Limitation of Liability

  • Pre-Existing Damage: We are not liable for damage caused by pre-existing conditions, unsafe site conditions, or client-provided materials.

  • Third-Party Providers: We are not liable for issues caused by third-party providers, such as dumpster rental companies or equipment vendors.

  • Force Majeure: Neither party is liable for delays caused by uncontrollable events (e.g., severe weather, natural disasters).

  • Liability: Our total liability is capped at the amount the Client paid us for services rendered within the six (6) months preceding any claim.

Our liability for any claim is strictly limited to the total amount paid by the client for services rendered in the six (6) months immediately preceding the claim. For any damage claims, please notify us promptly so that we may review the documented conditions and proceed accordingly.

15. Marketing and Photo Consent

  • Photo Documentation: We may use photos or videos taken during our services for marketing unless you opt out in writing before the service is completed.

  • Testimonials: Testimonials may appear in our marketing materials with your written consent.

16. Dispute Resolution

  • Mediation: Both parties agree to attempt mediation before arbitration or litigation.

  • Arbitration: Disputes unresolved through mediation will be settled by binding arbitration in Duval County, Florida.

17. Intellectual Property Rights

All content, trademarks, service marks, logos, and other intellectual property on our website or provided during services belong to DZ Junk Hawlers LLC or their respective owners. Unauthorized use is prohibited.

18. Governing Law and Jurisdiction

These T&C are governed by the laws of Florida. Any disputes related to these T&C or our services will be handled in the courts of Duval County, Florida.

19. Entire Agreement

These T&C are the complete agreement between you and DZ Junk Hawlers LLC regarding our services and replace any previous agreements or understandings, whether written or oral.

20. Changes & Modifications

  • Policy Updates: We reserve the right to update these Terms & Conditions. Any changes affecting existing bookings will be communicated in advance.

  • Operational Adjustments: We reserve the right to modify business hours, pricing structures, or service availability based on business needs. Clients will be notified of changes affecting existing bookings.
